18.1 Any dispute arising under these Terms shall be settled by binding arbitration administered by the American Arbitration Association’s Consumer Arbitration Rules. The arbitration hearing shall be conducted in Utah County, Utah. Judgment on the award rendered by the arbitrator may be entered in the state or federal courts located in Utah County, Utah.

18.2 You and we waive any right to participate in a class, collective, or representative action.

18.3 The party that does not prevail in any arbitration or court proceeding shall pay all fees, costs, and expenses incurred by both parties in connection with that dispute, including, but not limited to, attorneys’ fees, expert witness fees, court or arbitration fees, administrative fees, and all other reasonable costs.
